Insurance Claim Lawyers in Karachi

Rejected and delayed insurance claims

MSA Law Chamber advises and represents clients in insurance-related matters involving policy disputes, claims, coverage issues, liability and regulatory proceedings in Karachi and across Sindh. The work covers insurance claims, disputes over policy terms, compensation, recovery and related litigation, so you understand your rights, available remedies and the next step.

We assist policyholders, businesses and other clients with insurance disputes, claim-related issues, policy interpretation, liability matters and enforcement of contractual obligations. Where negotiation, settlement or another practical resolution can resolve the matter efficiently, that option is considered before pursuing prolonged litigation.

Most enquiries concern a claim that has been rejected, partly paid or left pending: health and life policies, motor and property losses, marine cargo and business interruption. Depending on the policy and the amount, the options include a complaint to the Federal Insurance Ombudsman or a claim before the Insurance Tribunal under the Insurance Ordinance, 2000, which also provides for liquidated damages on late payment of claims. 3. Respond to the insurerWe send a detailed reply or legal notice addressing each ground raised.
  4. Choose the forumIf the claim remains unpaid, we advise on a complaint to the Insurance Ombudsman or a claim before the Insurance Tribunal.

Documents we usually need

  • Policy document, schedule and any endorsements

  • Surveyor or loss-adjuster reports
  • The insurer’s rejection letter or correspondence
  • Proof of loss: FIR, medical records, death certificate, repair estimates or stock records, as relevant

Courts, forums and authorities

The Insurance Ordinance, 2000 governs insurers and policyholder claims. Under Section 118, if an insurer fails to pay a valid claim within ninety days of the payment becoming due or the claimant completing the requirements (whichever is later), liquidated damages are payable at five percent above the prevailing base rate, unless the delay was beyond the insurer’s control.

Why MSA Law Chamber

  • We read the policy wording closely, because most claim disputes turn on an exclusion or condition.
  • We pursue late-payment damages where the Ordinance provides for them, not only the principal claim.
  • Scope of work and fees are discussed and confirmed with you before work starts.

If you have submitted complete papers, Section 118 of the Insurance Ordinance, 2000 entitles you to liquidated damages for delay beyond ninety days, unless the delay was beyond the insurer’s control. A legal notice followed by a claim before the Insurance Tribunal is often the next step.

The Ombudsman deals with complaints of maladministration and can be quicker; the Tribunal decides claims as a court with civil-court powers. The better choice depends on the amount, the dispute and the evidence, and we advise on this case by case.

The policy schedule and wording, the claim form, the rejection letter, surveyor or medical reports, receipts and all correspondence with the insurer. The rejection letter matters most because it shows the ground the insurer relies on.

Yes. A partial payment can be challenged where the insurer has applied the policy incorrectly, for example on valuation, depreciation or an exclusion. Signing a discharge voucher in full and final settlement can affect your position, so take advice before you sign.
