Background
The petitioner joined the Karachi Port Trust (KPT) as a Traffic Supervisor 2nd Grade on 12.05.1986. He was promoted to Traffic Inspector 2nd Grade on 12.08.2016 and Traffic Inspector 1st Grade on 13.06.2017, and retired on 04.05.2019.
He filed two constitutional petitions under Article 199 of the Constitution. In C.P. No. D-609 of 2021 he challenged a KPT letter dated 21.12.2020 declining his request for an annual increment for 2016, which he claimed under a 1968 Board Resolution. He asked for the increment, recalculation of his pension, commutation and gratuity, and profit. He said other promoted officials had been given similar benefits, even after retirement, and that refusing him was discriminatory under Articles 4 and 25. In C.P. No. D-7231 of 2019 he challenged a letter dated 28.10.2019 and sought a dual-duty or higher-post allowance from 24.07.2018 to his retirement.
KPT's position
For KPT it was argued that the petitions were not maintainable because an alternative forum was available: pay matters of this kind fall within the jurisdiction of the Commissioner, Payment of Wages. KPT stated that the petitioner had already received the annual increment for 2016 and had expressly opted not to avail the benefit of Rule 19 of the KPT Pay, Allowances and Leave Rules. It also argued that an earlier petition on the same facts had been withdrawn with permission to approach the competent forum, and that the request about his promotion date was made only after retirement.
Issues before the Court
- Was the petitioner entitled to a further annual increment for 2016 and the related recalculation of retirement benefits?
- Was he entitled to the claimed dual-duty or higher-post allowance?
The Court's reasoning and outcome
After hearing counsel and examining the record, the Division Bench noted that the petitioner, as a retired KPT employee, had already received the annual increment in 2016 and had opted not to avail the benefit of Rule 19 of the KPT Pay, Allowances and Leave Rules. On that basis both petitions were dismissed in their entirety, along with pending applications, with no order as to costs.
Why it matters
Claims for increments and allowances by employees of statutory bodies often depend on the employee's own options and the record of what was actually paid. This order shows the High Court looking at those facts before anything else. For employers such as port and municipal bodies, keeping clear records of options exercised under pay rules can decide such cases. For employees, it is worth checking the record and the correct forum before filing.
